Terms of Service

These Terms of Service ("Terms") govern your use of www.aonestump.com(the "Site"), the A1 Easy Estimator, quote emails, and related online tools operated by A1 Stump & Tree Service("A1," "we," "us"). By using the Site, submitting an Easy Estimate, or accepting a quote, you agree to these Terms and our Disclaimer and Privacy Policy.

1. Who we are

A1 Stump & Tree Service provides tree care and related services across the Bay Area, including tree removal, trimming, stump grinding, relocation, planting, emergency response, and maintenance plans. 2. The Site

Site content is for general information. It is not a substitute for a site-specific assessment of your trees or property. You agree not to misuse the Site (including attempting to disrupt security, abuse forms, or upload malware).

3. A1 Easy Estimator

The Easy Estimator lets you select services, upload photos, share location and schedule preferences, and send contact details so we can follow up with pricing. You agree that:

• Information and photos you submit are accurate to the best of your knowledge.
• You have the right to upload the photos (for example, you own them or have permission).
• You grant A1 a limited license to use submitted photos and job details to prepare quotes, schedule work, document the job in our CRM, and train staff on quality and safety. We do not sell your photos. Marketing use of identifiable property photos requires your separate permission.
• Submissions may be protected by Cloudflare Turnstile or similar anti-abuse tools.

4. Estimates and quotes

Photo-based and virtual estimates are ranges or provisional quotes, not a final fixed-price contract for every condition on site. Final pricing may change if access, tree condition, utilities, permits, or scope differ from what was described. We will communicate material changes before proceeding with work beyond the agreed scope.

Quotes may include an expiration date. After expiry, pricing may need to be refreshed. Payment terms shown on a quote or invoice (for example, due on completion or net terms) apply to that document.

5. Accepting a quote

When you accept a quote online (or by other written means we provide), you:

• Acknowledge the stated service summary and estimate range or amount.
• Agree to these Terms, including Section 6 (Scheduling & Cancellation).
• Authorize A1 to contact you to confirm a scheduled start date and time window.

Acceptance is not a blank authorization for unlimited extra work. Material scope changes require updated pricing before that work continues.

6. Scheduling & cancellation policy

After you accept a quote, A1 will confirm a scheduled start (date and time window). Fees below are measured from that confirmed start. Weather, safety, or equipment issues that cause A1 to delay or reschedule do not create a customer fee.

Scheduling fees may be invoiced separately or applied to your account. Unpaid fees may delay future scheduling. Accepting a quote includes affirmative agreement to this policy (you will also see a checkbox on the online accept page).

7. Permits, utilities, and property access

You are responsible for obtaining required city permits, HOA approvals, and access permissions unless we agree in writing to handle them. You must disclose known underground utilities, gates, animals, and access limits that affect safe work.

8. Limitation of liability

To the fullest extent permitted by California law, A1 is not liable for indirect, incidental, or consequential damages arising from Site use or provisional online estimates. Nothing in these Terms limits liability that cannot be limited under applicable law (including for fraud or willful misconduct). Field work remains subject to our insurance and the written scope for that job.

9. Governing law

These Terms are governed by the laws of the State of California. Disputes will be resolved in the state or federal courts located in Santa Clara County, California, unless applicable law requires otherwise.

10. Changes

We may update these Terms. The effective date and version above will change when we do. Continued use of the Site or accepting a new quote after an update constitutes acceptance of the revised Terms for that use.
